Court orders Kano AG to open charges against Doguwa over alleged murderer

The Kano State Attorney General, Musa Lawan has been directed by the Kano State High Court to file a charge against Majority Leader of the Federal House of Representatives, Alhassan Ado Dogowa.

According to The PUNCH, the directive was issued subsequent to an application for a mandamus order by a retired Chief Magistrate from Kano, Muntari Garba Dandago, which sought to compel the Attorney General to initiate the filing of the aforementioned charge.

The Order of Mandamus is a legal writ that is issued by a court of higher authority to direct an inferior court or an individual to fulfil a public or statutory obligation.

The order was granted by the Court based on an ex parte motion presented by Y.I Shariff’s legal representative.

The Applicant submitted a motion ex parte that included 19 paragraphs of affidavit in support, which was duly sworn by the Applicant on April 5, 2023. Additionally, the Applicant’s Counsel filed a written address on April 10, 2023.

Delivering a ruling on the motion, Justice Sabo upheld that ”Leave is hereby granted to the Applicant to apply for the issuance of an order of mandamus against the respondent, that is Attorney General of Kano State, compelling him to exercise his power under section 211 of the Constitution of Federal Republic of Nigeria (as amended) to immediately file a charge against Doguwa and his conspirators for the offences of criminal conspiracy, culpable homicide, mischief, incitement of public disturbance and possession of firearms before a court of competent jurisdiction.”

The Court adjourned the case to May 12, 2023, for the hearing of the motion on notice.
